isty and Steven Powell are celebrating Wednesday night after they won their appeal to keep their tropical fish distribution business running from out of their garage.
Zoning administrators had deemed the garage a warehouse, which is illegal in their neighborhood, but the couple just won their appeal against the city of Gilbert.
The Powells' house looks just like any other in the Gilbert subdivision Agritopia.
What you can't see from the outside, however, is a tropical fish distribution business the Powells run from the garage in their backyard.
The business, Tropaquatics, receives shipments of tropical fish, and then distributes the fish to approximately 60 tropical fish stores throughout Arizona.
The Town of Gilbert received an anonymous complaint about the Powell's business and the planning department investigated.
That investigation ultimately resulted in the Powells receiving a complaint from zoning administrators alleging the Powells were running a warehousing business, which violates town code.
"It doesn't make sense, it's like does somebody have a vendetta against them," asked neighbor Dior Tidwell. "It's like they've been attacked."
The Powells contend their garage is merely a packing station, not a warehouse.
Tropaquatics has appealed the complaint and, on Wednesday night, will go before Gilbert's Board of Adjustment.
"I think it's wrong, you should be able to operate a business out of your home if you want to," said Jennifer Clark of Gilbert. "It's not bothering the neighbors."
